Terms of Service

The terms on which Skai Solutions provides its AI phone agent service.

This is a starting structure covering the commitments already made publicly on this site. It is not legal advice and has not been reviewed by a lawyer. Have it checked, and complete the bracketed fields, before relying on it.

1. The service

Skai provides an AI phone agent that answers inbound calls to your venue, takes orders and bookings, answers questions, and passes information to your POS or booking system where connected.

2. Your account

You are responsible for the accuracy of the configuration you provide - menus, prices, opening hours, policies, and for keeping it current. Skai answers callers using the information you supply.

3. Fees and billing

Fees are as set out in your order form or quote. Subscription fees are billed monthly in advance. The one-off setup fee is charged once, before go-live. Usage beyond your plan's included minutes is charged at the per-minute overage rate shown on your order form. Prices are stated in Australian dollars or New Zealand dollars, as shown on your order form, and are not inclusive of GST.

4. Term and cancellation

The service is provided month to month with no lock-in contract. Either party may terminate on 30 days' written notice. Fees already paid for the current period are not refundable except where required by law.

5. Your phone number

You retain ownership of your phone number. The service operates by call divert, and you may remove the divert at any time.

6. Call recording

Calls are recorded and transcribed as described in our Privacy Policy. You are responsible for meeting your own disclosure obligations to your customers. Skai provides configurable disclosure settings to assist.

7. Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be notified where practical. [SERVICE LEVEL TERMS, IF ANY].

8. Acceptable use

You must not use Skai for unsolicited outbound marketing calls, or in any way that breaches the Australian Do Not Call Register Act 2006, the Spam Act 2003, the New Zealand Unsolicited Electronic Messages Act 2007, or any other applicable law. Skai is provided for inbound calls to your venue.

9. Intellectual property

Skai retains all rights in the service and its software. You retain all rights in your menu, brand and business data.

10. Liability

Nothing in these terms excludes rights under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or the Australian Consumer Law where those apply. Subject to that, our total liability in any 12-month period is limited to the fees you paid in that period. We are not liable for indirect or consequential loss.

Skai is an automated system and may occasionally make errors. You remain responsible for confirming orders and bookings before fulfilling them.

11. Changes to these terms

We may update these terms and will give you 30 days' notice of any material change.

12. Governing law

These terms are governed by the laws of New Zealand.
